Protecting Assets and Maximum Income for the Community Spouse ...

One of the biggest mistakes that many spouses make when the other spouse enters a nursing home is not getting legal advice from an elder law attorney about Medicaid, known in Massachusetts as ?MassHealth.? The ?free? information that many community spouses (which under MassHealth law means any spouse who is not in a nursing home) often rely on can turn out to be quite costly to them.

There are different layers in MassHealth law, and many persons only seem to know about the bottom layer, so let?s go over that one first. Under 2012 law, just about everything other than the home and car are totaled, and the community spouse supposedly can keep only the first $113,640. (The rest of the assets are effectively owned by the spouse in the nursing home, and supposedly have to be spent on the nursing home bills of the institutionalized spouse; but note that I intentionally wrote the word ?supposedly.?)? Unfortunately, this lower layer is where the knowledge of many persons ends, and two other upper layers of the law effectively override the lower layer. One upper layer is that the community spouse can enter into certain types of immediate annuity contracts with the spenddown (i.e., excess) assets.

Before even thinking about buying an annuity, the community spouse should keep three things in mind: (1) not every immediate annuity will work, where Massachusetts law makes most annuities assignable and the annuity has to be nonassignable under federal Medicaid law and MassHealth regulations; (2) the published regulations and unpublished internal procedures and policies which now allow such a move can change with little advance notice, so it is often not advisable that an annuity be purchased until the institutionalized spouse?s nursing home stay has already begun; and most importantly (3) some community spouses can keep everything without needing an annuity, and are better off without an annuity, due to the other upper layer of MassHealth law that protects income for the community spouse.

At present, the community spouse has the absolute right to an income of at least 1,839 per month. (Further, if shelter expenses exceed 30% of this figure, or $552, or if a disabled child lives at home, the community spouse is often entitled to keep much more than $1,839 per month.) If the Social Security and pension payable in the name of the community spouse is less than the $1,839 figure,?at the end of the MassHealth application process the community spouse is allowed to keep some or all of the institutionalized spouse?s income.? Because the monthly payment from an immediate annuity is?considered to be the community spouse?s income, buying an annuity before the basic numbers have been analyzed by an elder law attorney could prevent the community spouse from receiving income from the institutionalized spouse. (That means the annuity payments in some cases?would be?simply replacing income that the community spouse was already entitled to have, and the annuity ends up not benefiting the community spouse.)

If the needs of the community spouse are greater than $2,841 per month, a higher amount of income can sometimes be preserved for the community spouse via the fair hearing appeal process, where the need to keep the other assets has to be proved to maintain the financial ability to remain in the community.? A common situation where need can be fairly easily proved is where the community spouse is living in an assisted living facility and needs to be there due to frailty, medical condition or other special needs.?? Once the need to be in assisted living is established, the appeal is primarily about numbers and prevailing CD and money market interest rates, so the community spouse need not go to the hearing, and the elder law attorney can often handle it alone.

Another option to retain greater income for the community spouse is a Probate Court procedure known as separate support.? Since both spouses need legal representation in court, it is important that the institutionalized spouse have a durable power of attorney that allows the appointed person to hire a lawyer to represent the interests of the institutionalized spouse.

When spenddown?and appeal options are determined by an elder law attorney as potentially unsuccessful, the community spouse can often purchase certain types of immediate annuities, which should always be the last resort due to the manner in which the institutionalized spouse?s income ca be allocated to the community spouse for MassHealth purposes.

A warning to the trusting and the gullible:? There are elder law ?attorneys? and MassHealth application services who profit from selling annuities, so it is important to have the entire picture reviewed, and often to get a second opinion,?before rushing into purchasing an immediate annuity from somebody who claims to be helping you; they may instead be helping themselves (to a healthy commission).

A final note :? Maintaining the maximum retroactivity of the original MassHealth application is vital to preserve assets for the community spouse and to ensure that the nursing home will be paid by MassHealth, so the MassHealth fair hearing appeal process should never be overlooked if any type of notice of denial is ever received along the way.? Greek leaders face crunch talks as unions strike (Reuters)

ATHENS (Reuters) ? Greek leaders face crunch talks on Tuesday to secure a new international bailout and avoid a chaotic debt default, caught between EU demands that they accept painful reforms now and a national strike against more austerity.

Prime Minister Lucas Papademos negotiated through most of the night with Greece's European Union and IMF lenders, ending at 4 a.m. (0200 GMT) when the 24-hour strike was about to begin, closing ports and tourist sites and disrupting public transport.

Papademos, a technocrat parachuted in to lead the Greek government late last year, must persuade leaders of the three parties in his coalition government to accept the EU/IMF conditions for the 130-billion-euro ($170-billion) rescue.

"We must find a solution today," said one government official before the leaders' talks, which are expected to start later in the day.

With Greece's future in the euro zone in question, German Chancellor Angela Merkel told Athens on Monday to make up its mind fast if it would accept the deal - and its conditions of reforms to make the economy more competitive that are certain to lead to big cuts in living standards.

Finance Minister Evanagelos Venizelos said talks with the "troika" of lenders - the European Commission, European Central Bank and IMF - were not going well.

"Unfortunately the negotiations are so tough that as soon as one chapter closes, another opens," he said after meeting troika officials on Monday night.

Early on Tuesday, the strike called by the private and public sector unions GSEE and ADEDY began to bite, bringing the country's main port to a standstill.

"No ships departed from Piraeus port this morning, as a result of the seamen's strike," said a coast guard official.

TOURISTS LOCKED OUT

In central Athens, tourists were locked out of the Acropolis and public transport was disrupted during the morning rush hour. State hospitals ran on a skeleton staff and teachers, bank employees and telecoms workers were due to join the action.

Greek party leaders face a general election possibly as early as April and have been reluctant to accept yet more austerity to be piled on top of a series of pay cuts, tax rises and job losses imposed since Greece's first bailout in 2010.

After weeks of argument a number major issues have yet to be sorted out at Tuesday's talks.

Greece has yet to identify spending cut measures worth 600 million euros this year, out of a total austerity package of about 3.3 billion euros, a government official said.

The troika was also demanding that private firms' labor costs be cut by about a fifth. This would be done by a combination of reducing the minimum wage by as much as 20 percent - a move that would drag the entire wage scale lower - by cutting holiday bonuses or by scrapping some industry-wide wage bargaining agreements.

Private sector workers currently receive holiday bonuses at Christmas, Easter and in the summer amounting to two months' pay in total, although such benefits have already been cut for public workers.

The troika also wanted top-up, supplementary pensions to be cut by about 15 percent on average to make the pension system financially viable, the official said.

Merkel - whose government funds much of the bailouts for Greece despite public hostility at home - expressed exasperation at the endless arguing in Athens.

"I honestly can't understand how additional days will help. Time is of the essence. A lot is at stake for the entire euro zone," she said in Paris.

Jean-Claude Juncker, who chairs the group of euro zone finance ministers, also backed a plan put forward by Merkel and French President Nicolas Sarkozy to set up a special escrow account into which Greece would make future interest payments as a means of guaranteeing that creditors were consistently paid.

However, Juncker denied that the euro was in danger because of the debt crisis. "The euro will outlive us all," he told German Inforadio on Tuesday.

EU officials say the full package must be agreed with Greece and approved by the troika before February 15 to allow time for complex legal procedures involved in the bond swap to be completed in time for a March 20 bond redemption.

In some euro zone countries, including Germany and Finland, parliamentary approval is required to raise the bailout money.

PATIENCE WEARING THIN

Greeks watched the political drama with the same exasperation they have shown throughout the nation's nearly three-year crisis, mixed with fear of the consequences of leaving the euro.

"We are lost either way but political leaders have to agree," said Kosmas Georgiou, a 31-year old company inspector. "Going back to the drachma is not an option, it's disaster."

"They are delaying this just to look like heroes."

Papademos said after five hours of talks on Sunday that leaders of the conservative, socialist and far-right parties in his coalition had agreed cuts and other reforms worth 1.5 percent of gross domestic product this year.

However, how exactly these cuts will be achieved has yet to be thrashed out, and every time a method is proposed, troika officials have to calculate whether this would achieve the savings they demand.

Anger after Russia, China block U.N. action on Syria (Reuters)

BEIRUT/UNITED NATIONS (Reuters) ? Western and Arab states voiced outrage Sunday after Russia and China vetoed a U.N. resolution that would have backed an Arab plan urging Syrian President Bashar al-Assad to give up power, and Washington vowed harsher sanctions against Damascus.

U.S. Secretary of State Hillary Clinton called the veto a "travesty." It came a day after activists say Syrian forces bombarded a district of Homs, killing more than 200 people in the worst night of bloodshed of the 11-month uprising.

Russia said the resolution was biased and would have meant taking sides in a civil war. Syria is Moscow's only big ally in the Middle East, home to a Russian naval base and customer for its arms. China's veto appeared to follow Russia's lead.

Washington's U.N. ambassador Susan Rice said she was "disgusted" by Russia and China's vetoes Saturday, and "any further bloodshed that flows will be on their hands."

British Foreign Secretary William Hague said Moscow and Beijing had turned their backs on the Arab world. France's Alain Juppe said they "carried a terrible responsibility in the eyes of the world and Syrian people."

Clinton said the United States would work with other nations to try to tighten "regional and national" sanctions against Assad's government "to dry up the sources of funding and the arms shipments that are keeping the regime's war machine going."

"We will work to expose those who are still funding the regime and sending it weapons that are used against defenseless Syrians, including women and children," she said. "We will work with the friends of a democratic Syria around the world to support the opposition's peaceful political plans for change."

Clinton did not give further details which nations might band together or precisely what they might do. But it appeared that the United States might seek to help organize a "Friends of Syria" group - proposed by French President Nicolas Sarkozy after the veto - to advance the Arab League initiative given the inability to make headway at the U.N. due to Russia and China.

All 13 other members of the Security Council voted to back the resolution, which would have "fully supported" the Arab League plan for Assad to cede powers to a deputy, a withdrawal of troops from towns and a start to a transition to democracy.

The Western criticism was echoed in the Middle East, where Arab powers like Saudi Arabia and non-Arab Turkey have turned decisively against Assad in recent months.

"Unfortunately, yesterday in the U.N., the Cold War logic continues," said Turkish Foreign Minister Ahmet Davutoglu. "Russia and China did not vote based on the existing realities but more a reflexive attitude against the West."

Arab League head Nabil Elaraby said the body still intends to build support for its plan. The veto "does not negate that there is clear international support for the resolutions of the Arab League," he said in a statement seen by Reuters.

The Security Council's sole Arab member, Morocco, voiced "great regret and disappointment" at the veto. Ambassador Mohammed Loulichki and said the Arabs had no intention of abandoning their plan.

Burhan Ghalioun, head of the opposition umbrella Syrian National Council, called Moscow and Beijing's veto "a new license to kill from these two capitals for Bashar al-Assad and his criminal regime, which just yesterday killed 300 people."

The SNC said it held Moscow and Beijing "responsible for the escalating acts of killing and genocide."

Protesters stormed the Russian embassy in Libya's capital Tripoli Sunday, climbing on the roof and tearing down the flag. Men held up a banner saying: "Libyan revolutionaries are ready to fight with their brothers in Syria."

MOSCOW SAYS RESOLUTION BIASED

Russia's U.N. envoy, Vitaly Churkin, accused the resolution's backers of "calling for regime change, pushing the opposition toward power and not stopping their provocations and feeding armed struggle."

"Some influential members of the international community, unfortunately including those sitting around this table, from the very beginning of the Syrian process have been undermining the opportunity for a political settlement," he said. Moscow is sending Foreign Minister Sergei Lavrov to Damascus Tuesday.

Clinton had met Lavrov before Saturday's vote for what U.S. officials called "vigorous" talks.

"What happened yesterday at the United Nations was a travesty," she said Sunday. "Those countries that refused to support the Arab League plan bear full responsibility for protecting the brutal machine in Damascus."

She added: "Faced with a neutered Security Council, we have to redouble our efforts outside of the United Nations with those allies and partners who support the Syrian people's right to have a better future."

Syria says it is being targeted by the West and by hostile neighbors providing diplomatic cover for an armed insurgency steered from abroad.

Syrian U.N. envoy Bashar Ja'afari condemned the resolution and its sponsors, which included Saudi Arabia and seven other Arab states, saying nations "that prevent women from attending a soccer match" had no right to preach democracy to Syria.

He also denied that Syrian forces killed hundreds of civilians in Homs, saying "no sensible person" would launch such an attack the night before the Security Council was set to discuss his country.

State television showed live footage of Assad Sunday praying with Muslim clerics and listening to Koranic verses in a Damascus mosque to mark the birthday of the Prophet Mohammad.

Residents of Homs's battered Baba Amro district, speaking by telephone, denounced the Russian-Chinese veto, some chanting, "Death, rather than disgrace."

One resident who identified himself as Sufyan said: "Now we will show Assad. We're coming, Damascus. Starting today we will show Assad what an armed gang is." Assad has called his opponents "armed gangs" and "terrorists" steered from abroad.

BOMBARDMENT

If activists' accounts are accurate, the bombardment of Homs Friday night was one of the bloodiest episodes of the Arab Spring uprisings sweeping the region and the deadliest incident in the Syrian conflict.

Syrian activist groups gave varying tolls above 200 killed, saying tanks and artillery blasted the Khalidiya neighborhood of Homs, a restive city that has become a heartland of resistance to Assad's rule.

Rami Abdullrahman of the Britain-based Syrian Observatory for Human Rights said that as of Sunday he had a list of 159 names of people confirmed killed in that incident, lower than the figure cited by the main political opposition. He said his list was not yet complete.

Damascus denies firing on houses and says images of dead bodies on the Internet were staged. Western governments say they believe the activists' account.

"Yesterday the Syrian government murdered hundreds of Syrian citizens, including women and children, in Homs through shelling and other indiscriminate violence, and Syrian forces continue to prevent hundreds of injured civilians from seeking medical help," U.S. President Barack Obama said before the U.N. vote.

"Any government that brutalizes and massacres its people does not deserve to govern," Obama said in a statement.

There were reports of more violence Sunday. Activist Omar Shakir, in the Baba Amro district of Homs, said there was new shelling Sunday afternoon and three people had been killed.

Abdulrahman's group said a total of 19 people had been killed by security forces across the country, and that a total of 21 government troops had died fighting with defectors.

Syria's state news agency SANA reported the funerals of three security personnel, adding to its announced toll of some 2,000 government forces killed during the uprising.

Syria restricts access to the country for journalists, and there was no independent verification of any of the reported death tolls in Syria Sunday.
